# Terms of Service & Disclaimer

## 1. Acceptance of Terms

By using Mail-to-Nostr ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. Your use of the Service constitutes your acceptance of these Terms.

## 2. Description of Service

Mail-to-Nostr is an email-to-Nostr gateway that receives emails via SMTP and forwards them as encrypted Nostr direct messages (NIP-04 DMs) to specified Nostr public keys. The Service acts as a **message conduit and intermediary** — it transmits user-provided content but does not create, author, sponsor, or endorse any content transmitted through it.

## 3. No Warranties

**The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind**, whether express, implied, or statutory. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

- Implied warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Reliability, availability, or timeliness of the Service
- Accuracy or completeness of message delivery

We do not guarantee that the Service will be uninterrupted, error-free, secure, or that messages will be delivered successfully. Emails may be lost, delayed, or corrupted.

## 4. Limitation of Liability

To the maximum extent permitted by applicable law, **we shall not be liable for any indirect, incidental, special, consequential, or punitive damages**, including but not limited to:

- Loss of profits, data, or email content
- Failure of message delivery
- Service interruption or downtime
- Actions of third parties (Nostr relay operators, Lightning Network nodes)
- Any damages arising from your use of or inability to use the Service

Our total aggregate liability for any claim arising from the Service shall not exceed the amount you paid us in the preceding 30 days.

## 5. Lightning Payments

- **All Lightning payments are final and non-reversible.** The Lightning Network does not support chargebacks or refunds.
- We do not provide refunds for paid features under any circumstances, including but not limited to service downtime, feature deprecation, or account issues.
- Paid features expire after 30 days. There is no auto-renewal.
- We do not custody, hold, or control user funds. We are not a financial institution, money transmitter, or payment service provider. Lightning payments are peer-to-peer transactions on the Lightning Network.
- **Nothing on this Service constitutes financial advice.**

## 6. User Responsibilities

You are solely responsible for:

- The content of all emails you send through the Service
- Ensuring your use complies with all applicable local, national, and international laws
- Maintaining the security of your Nostr private keys
- Obtaining consent from intended recipients before sending messages
- Any consequences of messages you transmit through the Service

You agree **not to** use the Service to:

- Send spam, unsolicited commercial email, or mass mailings
- Transmit illegal, harmful, threatening, abusive, harassing, defamatory, or fraudulent content
- Distribute malware, viruses, or malicious code
- Impersonate any person or entity
- Violate any law, regulation, or third-party rights
- Attempt to disrupt, overload, or gain unauthorized access to the Service

## 7. Intermediary Status

Mail-to-Nostr is a **conduit service**, not a content provider or publisher. We do not:

- Monitor, review, or screen transmitted content
- Exercise editorial control over messages
- Have knowledge of the specific content transmitted (it is processed in RAM and not stored)

We reserve the right to refuse or block transmissions that violate these Terms or applicable law, but have no obligation to do so.

## 8. No Affiliation

Mail-to-Nostr is **not affiliated with, endorsed by, or sponsored by** the Nostr protocol developers, any Nostr relay operators, the Bitcoin Lightning Network, or any related projects or organizations. "Nostr" and "Lightning" are properties of their respective owners.

## 9. Third-Party Services

The Service relies on third-party infrastructure:

- **Nostr relays:** Messages are delivered via independent third-party relays. Relay operators can observe event timing and metadata. We do not control and are not responsible for relay privacy practices, uptime, or behavior.
- **Lightning Network:** Payment routing involves independent Lightning Network nodes. Transaction metadata may be visible to routing nodes.
- **Email infrastructure:** Messages traverse SMTP servers that may be operated by third parties.

We are not responsible for the actions, policies, or failures of any third-party service.

## 10. No Direction to Restricted Jurisdictions

**This Service is not directed at, or intended for use by, persons in jurisdictions where such use would be illegal or require licensing that we do not hold.** This includes, but is not limited to:

- United States persons (as defined under U.S. law)
- Persons in jurisdictions subject to comprehensive sanctions (OFAC, EU, UN)
- Persons in jurisdictions where cryptocurrency or Lightning Network use is prohibited

If you are located in such a jurisdiction, you must not use the paid features of the Service. The free tier (email-to-Nostr forwarding) is available globally.

**It is your responsibility to determine whether your use of this Service is legal in your jurisdiction.** We make no representation that the Service is appropriate or available for use in any particular jurisdiction.

## 11. Export and Sanctions Compliance

You represent and warrant that:

- You are not located in a country subject to comprehensive international sanctions
- You are not on any restricted party list (OFAC SDN, EU restrictive measures, UN sanctions)
- You will not use the Service in violation of any export control or sanctions law

## 12. Service Availability and Modification

- We reserve the right to **modify, suspend, or discontinue the Service** at any time, with or without notice.
- We may add, remove, or change features at any time.
- During the beta phase, APIs may change and purchased data may be reset.
- We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

## 13. Intellectual Property

The Service design, software, and documentation are provided by Mail-to-Nostr. You retain all rights to the content you transmit through the Service. We claim no ownership of your content.

## 14. Indemnification

You agree to **indemnify and hold harmless** the Service operators from any claims, damages, losses, or expenses (including legal fees) arising from:

- Your use of the Service
- Content you transmit through the Service
- Your violation of these Terms
- Your violation of any law or third-party rights

## 15. Force Majeure

We shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, network failures, or government actions.

## 16. Governing Law

These Terms are governed by the laws of the jurisdiction in which the Service operator is established. Any disputes shall be resolved in the courts of that jurisdiction, to the extent permitted by applicable law.

## 17. Beta Disclaimer

During the beta phase:

- The Service is experimental and may contain bugs or errors
- APIs and features may change without notice
- Purchased feature data may be reset or wiped
- No guarantee of service continuity is provided
- Only one discount purchase per Nostr public key is permitted

## 18. Changes to These Terms

We may update these Terms at any time. The "Last updated" date above reflects the most recent revision. Continued use of the Service after changes constitutes acceptance of the updated Terms.

## 19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
